Biafra: Expectations Rise As IPOB Leader Nnamdi Kanu Heads To ECOWAS Court In High Spirit on 18th May, 2017

In what is happening in the ongoing court case, lots of articles have been written on the ECOWAS court with respect to the current case involving the leader of an emerging African Nation Biafra, Mazi Nnamdi Kanu and the federal government of Nigeria led by Muhammadu Buhari. Those articles were exposing the leniency and incompetence of the ECOWAS court of justice by the way they are handling the case instituted before her by Mazi Nnnamdi Kanu, the leader of the indigenous people of Biafra (IPOB) through his legal team against the Nigerian government. As Nnamdi Kanu heads to ECOWAS Court comes 18th May in high spirit, the court should as a matter of justice remain unbiased in administering and preserving the rule of law. If the ECOWAS Regional Court of justice go contrary to the expectations of Biafrans and the world at large in serving justice in this upcoming case billed to hold on the 18th May, 2017,  we will be left with no choice than to conclude that "ECOWAS Court has failed in her responsibilities in preserving and administering justice in West Africa using Kanu's case as a pointer.


However, the ECOWAS Court of justice as we know is the judicial organ of the Economic Community of West African States (ECOWAS) and is charged with the responsibility of resolving disputes related to the Community’s treaty, protocols and conventions. It is pertinent to also know that the ECOWAS Court of justice have the jurisdiction of hearing individual complaints of alleged human rights violations and  it rules according to the provisions of the African charter on Human and People’s Rights. And again, the decisions of the ECOWAS Court are legally binding to the ECOWAS member states of which Nigeria is part of.

A recap of what happened in the last court case, the ECOWAS Community Court of Justice dismissed a preliminary objection filed by the Federal Government of Nigeria challenging the jurisdiction of the court to hearing a case of breach of fundamental human rights filed by Nnamdi Kanu. The presiding judge, Micah Wright, held that the court had jurisdiction to entertain the applications and that the case is also admissible. The case has lingered for long and has also suffered unnecessary adjournment from the ECOWAS Court of justice.

Mr. Kanu, the Director of Radio Biafra and Leader of Indigenous People of Biafra (IPOB), sued the federal government for his prolonged detention without trial albeit being granted an unconditional release on 17th Dec, 2015. Joined in the suit filled are the Attorney-General of the Federation and Minister of Justice and the Director-General of State Security Services (DSS). Mr. Kanu, in the suit, is seeking $800 million compensation for violation of his human rights and an order directing his unconditional release and that of his personal belongings. He is also praying the court to direct the defendants to respect, protect and promote his rights to life, liberty and freedom of movement, assembly and expression, praying the court to also declare that his continued detention is a violation of the African Charter on Human and Peoples’ Rights, the Universal Declaration of Human Rights, the United Nations Charter of 1970 which Nigeria is signatory to as a member state.


Moreover, for the fact that the human rights of IPOB  leader Mazi Nnamdi Kanu  along with Chidiebere Onwudiwe, Benjamin Madubugwu and David Nwawuisi, has been trampled upon by the Nigerian government, hence leading to the filling of the case in the honourable court with the intention of obtaining or getting justice. This is so because we believe that the ECOWAS Court of justice cannot be biased or intimidated by any country or government and also that the court has competence and jurisdiction to hear and as well rule on human rights violations through an individual complaint procedure. Invariably, it appears that the reverse now is the case and we are watching them and also keeping record of events as they unfold. According to Aristotle The great philosopher "The aim of art is to represent not the outward appearance of things, but their inward significance. Suffice it to say that ECOWAS Court should live up to expectations and put a stop to the unnecessary postponement of this case so as to try to redeem the seemingly bastardized and rottened image of the hallowed  African judicial institution, which as well make the entire Biafrans to begin to doubt and question the integrity and competency of the Court of Justice and might make them also to lose hope in her just as they did to the Nigerian courts.

we all know the real truth in this case, and we think that the ECOWAS Court and African Union knows better than anybody does, that Nnamdi Kanu, the leader of the Indigenous people of Biafra (IPOB) is being persecuted because he wants a better life for his people in a restored Biafra.

ALERT :

According to the information on our desk now, those our members detained in different prisons and secret cells across the country are no longer safe and almost all of them are sick without proper medical attention, especially those in Kuje prison. We are calling for their immediate release to enable them take proper medical treatment because we will not take it likely with Nigerian government if anything untold happen to any of our members in detention anywhere in the contraption called Nigeria.   John F. We are now using this opportunity to call on men and women of good conscience across the globe, Amnesty International and relevant human rights organisations to prevail on the Attorney General of the Federation and the Judicial Service Commission to drop the concocted and fabricated charges preferred against our leader Nnamdi Kanu and others detained illegally alongside him in Kuje Prison because they committed no offence against anybody or Nigeria.

Conclusively, the injustice against the people of Biafra in Nigeria are numerous to mention and IPOB under the leadership of Nnamdi Kanu have decided to fight it to a standstill. Offcourse, many are aware that this is a project of God Almighty (Chukwu Okike Abiama) which IPOB embarked upon to liberate our people from the shackles of bondage. If you love our leader Mazi Nnamdi Kanu and Biafra, kindly show your support at the ECOWAS Court. Liberty is not collective, it is personal. All liberty is individually. - Calvin Coolidge.
