Nigeria Judiciary Needs To Step Up

It’s a shame to see that the judicial system is no longer followed and respected in Nigeria. The judiciary is the system of courts that interprets and applies the law in the name of the state. The judiciary also provides a mechanism for the resolution of disputes. Under the doctrine of the separation of powers, the judiciary generally does not make law or enforce law but rather interprets law and applies it to the facts of each case. This branch of the state is often tasked with ensuring equal justice under law. Though in many jurisdictions, the judicial branch has the power to change laws through the process of judicial review.

I had to state all these facts, in other to state the full power of the judiciary because most folks in Nigeria don't really know, including President Muhammadu Buhari who have decided to neglect the judiciary in Nigeria. In a democratic country like Nigeria, a president needs to make sure he\she never do anything to mess with the judicial power or you may be in lots of trouble but in Nigeria things are now different since the former military Dictator came back into power. Muhammadu Buhari insists he is a born-again democrat before he got into power, well that was mere propaganda to win the 2015 presidential election. Nnamdi Kanu have been in detention since the 18 of October 2015, the Nigeria court ordered his release on several occasion but Buhari insisted on not allowing him to jump bail, DSS and Buhari were shocked when the bail conditions were met so instead for them to release our Nnamdi Kanu they said they were investigating on the documentation of the asset presented to them. If a president can decide to choose which law to obey and to ignore then he is no longer a president.

The Nigeria judiciary must react with full force, because if the law is constantly disobeyed by Buhari then the judiciary no longer has credibility and can't be relied upon.  Another date have yet again been set for Nnamdi kanu on the 18 of January 2016, But we all know that President Muhammdu Buhari is just looking for diverse means to send Nnamdi Kanu to jail. The DSS and Buhari have no evidence or case to persecute Nnamdi Kanu, besides in the rule of law, you are innocent until proven guilty not guilty until proven innocent, so having Nnamdi Kanu arrested for the past 4 months and torturing him, is not just inhuman but woefully wrong. It’s a big disgrace to see that international human right law, United Nations and countries like the United States Of America who stand for law and order, also making sure that human right law is not abused, couldn't intervene and do anything in case of Nnamdi kanu.

What a shame! That is why I feel disgusted to see the way Buhari kicks about with the Nigeria Judiciary as if he's on the football pitch. It’s a pity that even the Nigeria Supreme Court is powerless to deal with the disobedience of Buhari. I think the Judiciary in Nigeria hasn’t done enough in their effect to ensure that Buhari respects and obeys the judicial system. So it’s left for the lawyers and judges in Nigeria to fight for their tenability because their prominence is at risk. Till the 18th of January 2016 when Nnamdi Kanu goes to court again, let's wait and see if Muhammdu Buhari will yet counteract the court.
