Breaking: Court Unconditionally Discharges Three IPOB Activists In PortHarcourt Maximum Prisons


The Rivers State Magistrate Court 8 presided by Chief Magistrate S.I JAJA unconditionally Discharges, Three IPOB activists illicitly arrested during the September 14 2018 IPOB Sit At Home exercise.

The victims were amongst those illicitly arrested on 14th September 2018 at Obigbo in their Homes by the Police and charged;

(i)That you Anieti Jacob and others at large on the 14th of September 2018 at Oyigbo PortHarcourt Magisterial district, did conspire amongst yourselves to commit felony to wit: Treasonable Felony/Arson

(ii)That you Anieti Jacob and others at large on the 14th day of September 2018 at Oyigbo PortHarcourt conduct yourselves in a manner likely to force or compel the President to change his measure by enforcing a SIT AT HOME order made by IPOB, with such intention by an act to take over the Government of Nigeria by force, thereby committed an offence punishable under Section 41 (c) of the criminal code Cap C38 Laws of Federation of Nigeria, 2004.

That you Anieti Jacob and others at large on the 14th day of September 2018 set on fire a Mercedes Benz valued 6million Naira, thereby committed an offence punishable under section 443(a) of the criminal code, Cap C38 Laws of Federation of Nigeria, 2004.

IPOB Legal Team filed an application for their Discharge and have since their arrest legally battled over their release before the Court.
The Prosecutor repeatedly absconded, even when hearing notices was served, thus their unconditional discharge.

At 1:pm the presiding Magistrate Rules:

All the defendants on the 20 of September 2018, appeared before this honourable court and charged for Treasonable Felony and Arson.
The defendants have been in Prison custody since then, awaiting the DPP'S advice. Hearing notices was served to the DPP on January 20th 2019, to appear and tell the court why the defendants should not be discharged.
The DPP have since then refused to respond, therefore I hereby discharge the defendants unconditionally and order that they be released from Prison custody with immediate effect.

The activists wholeheartedly appreciate the tremendous and unrelent efforts of IPOB led by Mazi Nnamdi Kanu and reaffirmed their support for the Biafra agitation.
The Family members of the freed activists were not exempted in the celebration, as they thanked IPOB Leadership for granting Legal and other support to the activists and securing their freedom.
