JUSTICE JOHN TOSHO 100 MILLION BRIBERY SCANDALS AND EFFECT ON JUDGEMENT

I am quite aware of this development; I had a lot of call-in asking why I have not written on the bribery scandal of Justice John Tosho. I replied that I am investigating the bribery scandal; I tried to make sure I logically brought to light this scandal hence I have concluded my investigation; I owe my numerous readers accountability.
I addressed my open letter to the Justice and also challenged his independence, but in a circumstance like this, where it is perceived that Kanu is an enemy of Nigeria for lawfully asking his right in a peaceful way, it would be unpatriotic on the side of justice Tosho as a Nigerian to be fair and serve justice without selection.

What this justice failed to grasp from my lecture is “justice is blind and the law has no enemy or friend, it sees every man as same” the law is unaware of Kanu’s position, what the law cares is, don’t break me. Once the law is broken, it turns and hunts you. For this sympathetic ruling, Justice Tosho has contravened the sanctity of the law.
Biafran family writers/journalists Mazi Okonkwo Isaac Somto and Ibeh Gift Amarachi who corresponded for Biafra Herald in Abuja during the court ruling spoke to a high ranking judiciary officer who spoke to them on condition of anonymity that Justice John Tosho really collected bribery of 100 million.

While we shall admit one of the reasons for not granting Kanu bail which is, the court holding that with two passports Kanu might jump bail, we should also look into our eyes and ask, what are the essence of sureties? Originally, accused persons are likely to jump bail but what holds them down is the surety provided and one would ask is the 100 million responsible for this unfair ruling? With sureties or a surety that matches the level of the alleged crime, I wonder why Kanu should not be allowed to enjoy bail while his trial last.

Again, Justice John Tosho labeled Kanu a national security threat, this however is negligence of fact or yet ruling out of the abundance of 100 million Naira bribery scandal. A national security threat for only asking for independence without arms but freedom of speech through radio Biafra, threat for peacefully agitation as enshrined in democracy? If asking for referendum or dialogue is threat to national security, then Justice John Tosho must be admitted in psychiatric hospital or go back to the fundamentals of law in school for believing that where national security is pronounced, people are thrown into prison without check and common sense of civilization and awareness of universal law as domesticated.

If justice John Tosho is hell bent to do the bidding of Buhari who said Kanu must not be granted bail or released, he should kindly find a good reason to back up his corruption and bribery. He is not dealing with dead brains and uncivilized men, I do not oppose his 100 million Naira bribery, I am more concerned about finding acceptable reasons to back up his dirty job.

The other reason that is unacceptable, that was likely given out of the abundance of 100 million Naira bribery scandal was thus this-- “Justice John Tosho in rejecting the accused person bail application on Friday held that they were not entitled to bail as they failed to show that they would not continue to commit the alleged crime for which they were being prosecuted.” it is clear that despite having not provided evidence or having failed to torture or convince Kanu into quitting the lawful agitation for an independent Biafra, Justice John Tosho seems to be playing the card of Buhari who gave him the bribe. He seems to be desperate to show his resolve to nail Kanu as job for the 100 million Naira bribery and for Kanu’s decision to continue Biafra agitation which irks Buhari.

Everything is falling in line with the resolve of Buhari who was tensed over the fairness of previous Justice who passed judgment without interference. His anger was visible during his maiden media chat, where he angrily responded to the question of granting Kanu bail. Recall that Buhari shopped for Judges for quite a long time before finally getting John Tosho, this came against the backdrop that Nigerian judiciary will refuse to entertain the case as contempt to the court was recorded by the executive. Justice Ademola also washed his hands off the case in defense of his character as one that would not like to be cowed by Buhari.

It is important to bring to the notice of Justice John Tosho, if he wants Kanu to drop the agitation for Biafra as seen in his ruling before he serves justice and give fair hearing, there must be stipulation and not by way of raping justice. Nnamdi Kanu had said that he can’t have justice in this country Nigeria and Justice Tosho is in to prove him right. I therefore call on men and women of goodwill to stand against conspiracy and injustice, injustice anywhere is injustice everywhere. Kanu must not be victim of bribery and corruption in Nigeria because he has not in any way committed any crime, neither has Nigeria in anyway given him anything. Self-determination is a legal course, constitutionalized by Nigeria and one would wonder why 100 million must be price for injustice on an innocent man.
