IPOB TO NATIONAL JUDICIAL COUNCIL: WHEN WILL YOU PEOPLE SUE FEDERAL GOVT AND DSS OVER HUMILIATION OF INCORRUPTIBLE JUDGES?

Since 7th to 9th October 2016, when the lawless organization in Nigeria called Department of State Services (DSS) which is not recognized by Nigeria constitution invaded the residence of the incorruptible judicial officers in Nigeria at mid-night, humiliated them, arrested them and detained them for nearly 48 hours in an operation which DSS code-named "Sting Operation" with allegation of corruption in the midst of the targeted judges in the bid to intimidate the judges to violate the judicial oath of office which they took as a result, bend judgments against Mazi Nnamdi Kanu and other perceived President Buhari's enemies, IPOB under the supreme command of Nnamdi Kanu is joining queue with other Nigerians of good conscience to ask Nigeria Judicial Council, when will you people sue the Government of Nigeria and DSS over the impunity they committed against the judges? It is obvious to National Judicial Council (NJC ) that the lawlessness of DSS which is noticeable in committing court contempts with the support of the president of Nigeria since December 17, 2015 when federal high court presided over by Hon Justice Adeniyi Ademola, gave a verdict of unconditional release of Mazi Nnamdi Kanu (Prisoner of Conscience), has reached a crescendo and zenith of it.

DSS has systematically without any remorse usurped the constitutional duties of NJC which is spelt out in the constitution. The constitution of Nigeria empowers NJC as only the authority to monitor the activities of a sitting judge, caution a judge of any misconduct, suspend or punish or dismiss a judge when necessary, recommend any judge to the executive arm of govt to prosecute after dismissal from all judicial activities, if found involved in crime or corruption and not the DSS or any other agency of the executive arm doing that without approval of NJC. This is always the modus operandi for handling sitting judges to avoid stampeding judicial processes by the executive arm. The action of DSS is a slap and rape on the independence of Nigeria Judiciary which no other arm of government should interfere into.

Now, as DSS has vehemently refused to tender apology to the NJC for over-stepping their boundary and usurping the powers constitutionally vested on NJC, instead boasting about their readiness to attack more incorruptible judges with a claim that there is no constitutional immunity covering a sitting judge, thereby can be arrested by DSS especially during an activity which in their opinion means "a sting operation", when will NJC sue DSS over their excesses? If Nigeria Judicial Council fails to sue DSS and claim damages from DSS, then Nigeria judiciary has lost relevance and its independence and thereby paving way for a regime of anarchy and lawlessness in Nigeria. Nigeria Bar Association should persuade NJC to stand their ground and sue Federal govt and its agency DSS for stampeding Nigeria judiciary.

If DSS is not sued and punished to serve as deterrent to any other agency of executive arm which may want to molest independent judicial arm of govt, soon DSS may invade the residence of Chief Justice of Nigeria, President of Court of Appeal, Chief of Federal High Court and arrest, humiliate and detain them or probably extend arrest to Attorney-General of federal, Mr Abubakar Malami SAN. How long will NJC waste time and do the needful which is to sue DSS over their obvious lawlessness which is already assuming a worrisome dimension in the country? Have NJC thrown away the petitions of Hon Justice Adeniyi Ademola to Chief Justice of Nigeria where he complained of how he is being punished for his stand for incorruptibility? What has bewitched Nigeria judiciary which is the third arm of govt that a common executive arm's agency which is not recognized by the constitution is now intimidating them and NJC look helpless? I am already seeing that 'Ghana Must Go' bags of money from Aso Rock since Nnamdi Kanu was arrested have castrated NJC. They can no longer do anything because DSS itself may be the channel through which Aso Rock delivers the bags of money to them. If NJC must purge themselves of the caricature DSS has meted on them, they must sue DSS in order to restore the authority, respect and independence of Nigeria judiciary. If they leave DSS to go unpunished, let them be ready to taste more venom of DSS or even NSCDC or at best Man O' war in a near future because nobody place value on them anymore. I rest my case!
